This privacy policy explains how Selwyn Connect (“we”, “us”, “our”) collects, uses, shares and protects your personal data, and your rights under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We are committed to handling the personal data of candidates, contractors, clients and website visitors lawfully, fairly and transparently.

2. The personal data we collect

The data we collect depends on your relationship with us.

Candidates and contractors

  • Identity and contact details (name, address, email, telephone number).
  • Right-to-work and identity documents (passport, visa, photo ID).
  • CV, employment history, qualifications, skills and references.
  • National Insurance number and, where relevant, UTR and limited-company details.
  • Bank or payment details for paying you or your company.
  • Timesheets, assignment records, rates and availability.
  • Where necessary, information about health or other matters relevant to an assignment or to reasonable adjustments.

Clients and client contacts

  • Names, job titles, business contact details and authorisation roles of the people we deal with.
  • Company details, billing information and purchase order references.

Website visitors

  • Information you submit through forms (for example enquiries or job applications).
  • Technical data such as IP address, browser type and pages visited, collected through cookies and similar technologies. See our cookie information below.

3. How we collect your data

We collect personal data directly from you (for example when you register, apply for a role or contact us), and from third parties such as clients, job boards, professional networking sites, referees and publicly available sources.

4. Why we use your data and our lawful bases

We only use your personal data where the law allows us to. The main purposes and lawful bases are:

  • Providing recruitment services — to match candidates to roles, manage assignments and maintain our relationship with clients. Lawful basis: performance of a contract and our legitimate interests in operating a recruitment business.
  • Paying and invoicing — to pay contractors and invoice clients and keep accurate financial records. Lawful basis: performance of a contract and compliance with a legal obligation.
  • Right to work, tax and regulatory checks — to meet our legal obligations. Lawful basis: legal obligation.
  • Keeping you informed of opportunities — to tell you about roles or services that may interest you. Lawful basis: consent or legitimate interests, and you can opt out at any time.
  • Special category data — where we process more sensitive information (for example health information for reasonable adjustments), we do so only where an additional condition under data protection law applies, such as your explicit consent or employment-law obligations.

5. Who we share your data with

We share personal data only where necessary, including with:

  • Clients and prospective clients, where we put you forward for or place you in a role.
  • Payroll, umbrella and accounting providers involved in paying you and managing invoices.
  • HMRC and other authorities where required by law.
  • Background-check, reference and right-to-work verification providers where relevant.
  • Our IT, hosting and email service providers who help us run our systems.
  • Professional advisers such as accountants and legal advisers.

We do not sell your personal data. Where any provider is located outside the UK, we ensure appropriate safeguards are in place as required by data protection law.

6. How long we keep your data

We keep personal data only for as long as necessary for the purposes set out above. In practice this means for the duration of our relationship with you and for a reasonable period afterwards, and longer where we must retain records to meet legal, tax or regulatory requirements (financial records are generally kept for at least six years). When data is no longer needed we delete or anonymise it securely.

7. Your rights

Under data protection law you have the right to:

  • Access the personal data we hold about you.
  • Ask us to correct inaccurate or incomplete data.
  • Ask us to delete your data in certain circumstances.
  • Restrict or object to our use of your data.
  • Request the transfer of your data to another organisation (data portability).
  • Withdraw consent at any time where we rely on consent.
